Agreement to Terms. These Terms of Use constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and Mesquite Trailer Rentals ("we", "us", or "our"), concerning your access to and use of the www.MesquiteTrailerRentals.com website (the "Site"). By accessing the Site, you agree that you have read, understood, and agreed to be bound by all of these Terms of Use. If you do not agree with all of these terms, you are prohibited from using the Site and must discontinue use immediately.
Services Offered
The Site offers the rental of trailers. Rentals are non-refundable and cannot be returned for a refund.
Deposits & Damage
A deposit may be required to reserve a trailer. Deposits will be returned when the trailer is returned with no missing equipment and no new damage. You are responsible for any damage to the trailer during the rental period.
Availability
Trailers are available on a first-come, first-served basis and subject to availability. The Site does not guarantee the availability of any specific trailer.
SMS / Mobile Messaging Program
Mesquite Trailer Rentals operates a mobile messaging program (the "Program"). We may send promotional and transactional mobile messages, including specials, offers, booking reminders, order notifications and appointment reminders. Messages may be sent using automated technology. Message frequency will vary but will not exceed 20 messages per month.
Opt-In. By providing your mobile phone number to us, you voluntarily opt in to the Program and agree to receive recurring mobile messages at that number. Your participation is not required to make any purchase and is completely voluntary. If you change or give up your number, please notify us at (361) 309-5928.
Opt-Out & Support. You may opt out at any time by replying STOP, QUIT, CANCEL, OPT-OUT or UNSUBSCRIBE to any message from us. You may receive a one-time opt-out confirmation. For support, reply HELP to any message. You are responsible for any message and data rates charged by your mobile provider. The Program is offered on an "as-is" basis and may not be available at all times or on all carriers.
Limitation of Liability
The Site shall not be liable for any damages of any kind arising from your use of the Site, including, but not limited to, direct, indirect, incidental, punitive, and consequential damages.
Termination
The Site reserves the right, in its sole discretion, to terminate or suspend your use of the Site at any time, with or without notice and without liability to you.
Modifications & Governing Law
We may modify these terms at any time; modifications are effective when posted. This agreement shall be governed by and construed in accordance with the laws of the State of Texas and the United States. This agreement constitutes the entire agreement between you and the Site and supersedes all prior agreements regarding the use of the Site.
By accessing or using the Mesquite Trailer Rentals website, you acknowledge that you have read, understood, and agree to be bound by these terms.
